These Terms and Conditions ("Terms") govern your use of the Actiwake mobile application ("App") developed by Onur Can Tanrıver ("we", "us", or "Developer"). By using the App, you agree to these Terms.

1. Service Description

Actiwake is an alarm clock application offering the following features:

  • Customizable alarm creation
  • Photo verification challenge
  • Step counting challenge
  • Widget and Live Activity support
  • Daily reminder notifications
  • Premium subscription features

2. Account and Usage

2.1 Eligibility

  • You must be at least 13 years old to use this App
  • You must have the legal capacity to enter into binding agreements

2.2 User Responsibilities

  • You agree to use the App only for lawful purposes
  • You must not engage in actions that compromise the App's security
  • You must not violate the rights of others

2.3 Acceptable Use

You agree NOT to:

  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any systems or networks
  • Interfere with or disrupt the App's functionality

3. Subscription and Payment

3.1 Premium Subscription

  • The App offers both free and premium (paid) features
  • A subscription is required to access premium features

3.2 Subscription Plans

  • Weekly Subscription: Automatically renews every week
  • Annual Subscription: Automatically renews every year

3.3 Pricing

  • Current prices are displayed in the App Store and within the App
  • Prices may vary by region
  • Price changes will be notified in advance

3.4 Payment and Renewal

  • All payments are processed through Apple App Store
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period

3.5 Cancellation

  • You can cancel your subscription at any time through your Apple ID account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial subscription periods

3.6 Refunds

  • Refund requests must be directed to Apple App Store
  • We do not directly process refunds

4. Intellectual Property

4.1 Ownership

  • All content, features, and functionality of the App are owned by Onur Can Tanrıver
  • The App is protected by copyright, trademark, and other intellectual property laws

4.2 License

  • We grant you a limited, non-exclusive, non-transferable license to use the App
  • This license is for personal, non-commercial use only

4.3 Restrictions

  • You may not copy, modify, or distribute the App
  • You may not create derivative works based on the App
  • You may not use the App for commercial purposes without permission

5. User Content

5.1 Photos

  • Photos taken for the photo challenge remain your property
  • Photos are stored locally on your device and are not uploaded to our servers
  • We do not claim any ownership rights over your photos

5.2 License Grant

By using the App, you grant us permission to process your photos on-device for the purpose of alarm verification

6. Disclaimers

6.1 "As Is" Basis

  • The App is provided on an "as is" and "as available" basis
  • We make no warranties, express or implied, regarding the App

6.2 No Guarantee

  • We do not guarantee that the App will be error-free or uninterrupted
  • We do not guarantee that the App will meet your specific requirements

6.3 Alarm Reliability

  • While we strive to provide reliable alarm functionality, we cannot guarantee that alarms will always trigger as expected
  • Important: Do not rely solely on this App for critical wake-up situations
  • Factors outside our control (device settings, battery, system updates) may affect alarm functionality

7. Limitation of Liability

7.1 Exclusion of Damages

To the maximum extent permitted by law, we shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Any damages resulting from your use or inability to use the App

7.2 Maximum Liability

Our total liability shall not exceed the amount you paid for the App or subscription in the past 12 months.

8. Indemnification

You agree to indemnify and hold harmless Onur Can Tanrıver from any claims, damages, losses, or expenses arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights

9. Modifications

9.1 Changes to Terms

  • We may modify these Terms at any time
  • Continued use of the App after changes constitutes acceptance of the new Terms
  • Significant changes will be notified through the App

9.2 Changes to the App

  • We reserve the right to modify, suspend, or discontinue the App at any time
  • We may add or remove features without notice

10. Termination

10.1 By You

  • You may stop using the App at any time
  • You may delete the App from your device

10.2 By Us

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through:

  1. Good faith negotiation
  2. If negotiation fails, binding arbitration in accordance with applicable laws

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
